  16. <p>An accused rapist insists an offered condom implied consent
  17. </p>
  18. <p>    It seemed the classic Catch-22 of rape, with an age of AIDS
  19. twist: a woman who protects her life by cooperating with her
  20. assailant -- in this case by offering him a condom -- risks the
  21. charge that she invited the assault. In Austin, Texas, the first
  22. grand jury that heard the case against Joel Rene Valdez may have
  23. concluded just that, refusing to bring charges against Valdez,
  24. who wielded a knife during the attack. Valdez apparently told
  25. the police -- and the local media -- that because his alleged
  26. victim had the presence of mind to provide him with a
  27. prophylactic in mid-rape, she clearly must have consented to
  28. sex. It is generally assumed the first grand jury concurred with
  29. the argument.

  31. <p>    But the women of Austin would have none of it. As
  32. demonstrators converged on the courthouse, prosecutors convened
  33. a second grand jury. This time Valdez was indicted for
  34. aggravated sexual assault. If found guilty, he could spend the
  35. rest of his life behind bars.
